Your Duty of Utmost Good Faith & Disclosure

Under the Insurance Contracts Act 1984 (Cth), you owe the insurer a duty of utmost good faith in relation to this claim. That means you must:

  • Provide accurate, complete and truthful information about the incident and any related circumstances;
  • Disclose every matter you know, or could reasonably be expected to know, that is relevant to the insurer's assessment of the claim;
  • Tell us promptly if any of the information you have given changes, or if new facts come to light.

If you do not comply, the insurer may reduce or refuse the claim, cancel the policy, or in cases of fraud, treat the policy as if it never existed and seek to recover amounts already paid.
